1. Who we are and what we do
PrimeAuto Connect Inc. (“PrimeAuto Connect”, “we”, “us”) is a licensed motor vehicle transport broker (FMCSA broker license MC-1754587, USDOT 4452107). We arrange transport. We are not a motor carrier and we do not move vehicles ourselves. An independent, separately licensed motor carrier performs the physical transport.
2. Acceptance of these terms
By requesting a quote, booking a shipment or using this site you agree to these terms and to our privacy policy. If you do not agree, do not use the site or book a shipment. Your booking confirmation and the carrier’s bill of lading are part of your agreement and control over this page where they differ.
3. Eligibility
You must be at least 18 years old and able to enter a binding contract. You must be the owner of the vehicle or authorised by the owner to ship it, and the vehicle must not be subject to a lien, seizure or legal hold that would prevent transport.
4. Quotes are estimates until a booking confirms them
- An online quote is an estimate based on road miles, the vehicle details you give, the trailer type, the date and current rates. It is not a binding offer.
- A price is firm only when your booking confirmation states it in writing.
- The price can change if information you gave was wrong or changes: a vehicle that does not run, a different size or number of vehicles, a changed address or a different date.
- Pickup and delivery dates are windows and estimates, not guarantees, unless your booking confirmation guarantees a date in writing. Weather, traffic, breakdowns, hours-of-service rules and other loads on the truck can move them.
5. Booking, payment and cancellation
- The total price, any deposit, who collects the balance, accepted payment methods and the cancellation and refund terms for your shipment are stated in your booking confirmation before you sign it. Nothing is charged until you accept that confirmation.
- You can ask to change or cancel at any time. Tell us in writing (email is fine). The cancellation terms in your booking confirmation apply.
- If the driver arrives and the vehicle is not ready as described (does not run when you said it did, keys missing, nobody present), the load can be cancelled and the trip charge stated in your booking confirmation can apply.
- We can cancel or reassign a load if a carrier falls through, if information is wrong, or for safety. If we cancel and have not moved your vehicle, we refund what you paid us for that shipment.
6. Your responsibilities
- Give accurate information about the vehicle, its condition and both addresses.
- Be present at pickup and delivery, or name an adult who can inspect the vehicle and sign for you. Anyone who signs the bill of lading signs on your behalf.
- Remove personal items and toll tags. Carriers’ cargo insurance generally does not cover contents. Illegal goods, weapons and hazardous materials may not be shipped inside a vehicle.
- Leave no more than a quarter tank of fuel, and tell the driver about anything unusual (alarm, kill switch, low clearance, modified suspension).
7. Pickup, delivery and the bill of lading
The driver and you inspect the vehicle at pickup and record its condition on the bill of lading, which is the carrier’s shipping contract and condition report. At delivery you inspect against it. Note any new damage on the bill of lading before you sign for delivery, and photograph it. A bill of lading signed without notes is strong evidence that the vehicle arrived in the condition recorded.
If a large truck cannot safely or legally reach an address, the driver may propose a nearby meeting point. Refusing a safe meeting point can delay or cancel delivery.
8. Insurance and damage claims
- The assigned carrier’s cargo insurance covers the vehicle in transit, subject to that policy’s limits, deductible and exclusions. A broker’s surety bond is a different instrument and is not cargo insurance.
- We check that the carrier’s operating authority and insurance are on file before dispatch. You can ask us for the carrier’s name, USDOT number and insurance certificate. We cannot promise that any insurer will pay any claim.
- If there is damage, note it on the bill of lading at delivery, photograph it and tell us as soon as possible, and in any case within the time stated in your booking confirmation or the bill of lading. We will help you file with the carrier and its insurer. Claims against the carrier are governed by federal law (49 U.S.C. § 14706) and the carrier’s bill of lading.
- Your own auto insurance may also respond. Check your policy.
9. Delays and events outside our control
We will tell you promptly when we learn that a pickup or delivery will be late. Neither we nor the carrier are liable for delays caused by events outside reasonable control, such as weather, road closures, accidents, mechanical failure, strikes, natural disasters or government action. If a delay is long, you can ask to cancel; section 5 applies.
10. Calls, texts and emails
When you give us a phone number or email, you agree that we and the carrier assigned to your shipment may contact you about your quote and shipment by call, text or email, including by automated means. Consent is not a condition of purchase. Message and data rates may apply. Reply STOP to any text to stop texts, or tell us to stop calls or emails. We do not sell your number.
11. Automated assistant
The chat on this site is an automated assistant, not a person. Its answers and estimates are information only and are not binding. Only a booking confirmation from us is. Do not share payment card numbers or passwords in the chat.
12. Acceptable use of the site
Do not scrape, overload or probe the site, submit false information, impersonate anyone, or try to access staff areas. We can block abusive traffic and refuse service to anyone who misuses the site.
13. Our content and intellectual property
The site, its text, design, software and the PrimeAuto Connect name and logo belong to us or our licensors. You may use the site for your own shipping needs. You may not copy, resell or build a competing service from it.
14. Disclaimers
The site and its tools (quotes, maps, fuel and toll estimates, tracking positions) are provided “as is” and “as available”. We try to keep them accurate, but we do not warrant that they are error-free, uninterrupted or complete. Tracking positions are the last position the driver shared and may be delayed.
15. Limits on our liability
To the fullest extent the law allows: (a) our total liability for any claim relating to a shipment is limited to the amount you paid PrimeAuto Connect for that shipment; (b) we are not liable for indirect, incidental or consequential losses, such as loss of use, rental cars, lost income or travel costs; and (c) loss of or damage to the vehicle in transit is the carrier’s responsibility under its bill of lading and federal law, not the broker’s. Nothing in these terms limits liability that cannot legally be limited, or limits the carrier’s liability to you under federal law.
16. Indemnification
You agree to cover our reasonable losses and costs (including reasonable legal fees) arising from false information you gave us, a vehicle you were not entitled to ship, prohibited items left in the vehicle, or your breach of these terms.
17. Governing law, disputes and state notices
- Please contact us first. Most problems are solved by talking, and we will respond within a reasonable time.
- These terms are governed by the laws of the Commonwealth of Pennsylvania and applicable federal law, without regard to conflict-of-law rules. Any dispute that is not resolved informally will be heard in the state or federal courts located in Chester County, Pennsylvania, unless the law of your state gives you the right to bring it where you live. Either party may bring an eligible claim in small claims court.
- Some states do not allow certain limitations or exclusions of liability, so parts of section 15 may not apply to you. You may have other rights that vary by state. California residents: you may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs.
- You can check our broker authority and bond on the FMCSA website using our USDOT number.
18. Changes to these terms, and contact
We may update these terms. The version in force when you accept a booking confirmation governs that booking. The date at the top shows when this page was last updated.
